A year ago, Odessan Mikhail Svetlov illegally fired from the communal enterprise CSW Cheremushki, where he served as chief of a department. Dismissal order was signed by the Acting Director of the company after Mikhail Svetlov refused to write a letter of resignation on their own. The grounds for the order was an act of truancy, which was drafted at a time when Michael was on sick leave.
It so happened that for health reasons at the hospital the man was forced to leave several times at intervals of several days. Coming from one hospital, Michael discovered that his job is busy. Then he talked with the director about what he had left a dream job, but because in his place interns another man a few days between the hospital he will be in other departments, the premises are located on the premises. Thus, Michael did not commit truancy, absenteeism because, by law, is the absence of an employee in the enterprise, rather than the workplace.
M. Svetlov: this was done retrospectively by two orders on the basis of fraudulent act of truancy. I was at the hospital and accidentally found out about it, calling the chief accountant to ask, plus giving me money or not. And she said to me: "You are fired by an act of truancy."
Michael went looking for the truth to the chairman of the district administration Malinowska Oleg Sirota. The head of administration summoned for an explanation of the Acting Director of CSW Yuri Pankov. He brought with him a head of department of legal and personnel work, which, according to Michael, "sat" in his place, and who, in his opinion, had falsified the act truancy.
M. Svetlov: they brought with them an act of truancy and the order of my dismissal. There were two signatures of women from the planning department with whom I was in a great relationship, and who saw that I had these two days was in the company. I was shocked when I saw their signature. Later, however, they told me that they were forced to put their signatures in the act. In the district administration head of the legal department told me: "You're fired on the basis of these documents, all right, if you want to go and negotiate in an amicable way."
Then Michael came back to the company, but there he was asked his resignation voluntarily. He refused to write.
M. Svetlov: then they gave me an order for dismissal, with an entirely different order, which is not featured two days of idleness, but one. I take this order go back to the Orphans and telling him: "what is it, first one ordered, and then for the same number another order, what kind of circus?" And he told me: "Go on, negotiated, I do not want none of this listen. I warned him that I would apply to all organs, including the court.
When the man turned to the mayor's office, a letter was sent out again in Malinowski district administration, where he received a reply that he was fired by an act of truancy. Seeing that the situation resembles a vicious circle, Michael sent a letter to the Prime Minister, who redirected the case to the Industrial Policy Ministry, and they, in turn - in the State Labour Inspectorate.
M. Svetlov: inspection checks made, which again showed that I was fired by an act of truancy, but it had been committed some violations. In particular, violated terms of the final calculation - with me had to pay on the day of dismissal, and paid off two months after that.
According to Michael, this is indirect evidence that the entire situation was concocted in haste, and it was done retroactively.
M. Svetlov: Inspection reported that offenders were brought to administrative responsibility, and advised me to go to civil court.
When Michael asked the prosecutor Malinowski area again check was made on the basis of which he was given the runaround, that's no reason for a criminal case no. Then the victim arrived at the reception to Eduardo Dobrynin, who at the time top usa online casinos headed the police department of the city. Policeman redirected a complaint with the police department Malinowski.
M. Svetlov: I called back, I gave testimony, but after that I was not given any answer, neither written nor oral.
Then Michael left one hope - to the court.
M. Svetlov: I had no choice but to go to court. A year already listened to my case, although the claims for reinstatement of the case should be heard a month, maximum two. The judge always takes a listen. First half-year pre-trial hearing lasted, but now I have to call those women who signed the act of truancy, and, naturally, they are not in court.
It is interesting that for some time before being dismissed from Michael had a conversation with the Acting Director of CSW that he may retire on the transfer.
M. Svetlov: I told him that if I resigned, I will bring him a letter. So, when I was lying on the sick, he calls me and says: "Where's the letter?" I answered him that I was on sick leave when I get to be a letter to him. And he said to me: "Come quickly carry it to me a letter, or I'll fire you for absenteeism. Here, he threatened me, and a week later came this act of truancy.
Thus, employees of CSW, instead of thinking about how to ensure the residents of Odessa, a normal life - a clean yard, lighted parade, with water and a warm, engaged in fraud, illegal dismissal of people, and seek truth ordinary employee is almost impossible.
